Terms and conditions
By entering the 2018 Experience Queensland Life Sciences Competition (“the Competition”), you agree to the following terms and conditions:
1.0 The Competition
1.1 The Competition is conducted by the State of Queensland (through the Department of Environment and Science (the Department) (ABN 46 640 294 485) of the EcoSciences Precinct, 41 Boggo Rd, Dutton Park, Brisbane, 4000.
2.0 General Terms
2.1 Entry into the Competition is deemed acceptance of these terms and conditions (the Terms).
2.2 If there is any inconsistency between these Terms and anything else that refers to this Competition, these Terms will prevail.
2.3 The Department reserves the right to vary these Terms at any time in its sole and absolute discretion.
2.4 All decisions made by the Department throughout the Competition are final.
2.5 The Department may, in its sole and absolute discretion, add, modify or delete information related to this Competition including, but not limited to, registered Competition activities, competition participants and events.
2.6 Any content generated by Competitors may be used by the Department for promotional purposes.
2.7 All amounts are in Australian dollars.
3.0 Who can enter
3.1 Entry is only open to registered competition participants, and excludes employees and their immediate families of the Queensland Government. Immediate family includes the following: siblings, defacto, spouse and children.
3.2 The Department may deem any entry invalid in its sole and absolute discretion.
3.3 Competitors must be aged 18 or over at the time of joining the Competition.
3.4 The Department reserves the right to require proof of age, residency, holding of a valid passport, ability to obtain a suitable visa for travel to Australia and enjoyment of the prize, ability to travel, ability to fly and any other eligibility criteria the Department considers relevant, before a winning Competitor can be awarded a prize.
3.5 By entering the Competition, competitors are providing consent for the Department to use and disclose the competitor’s personal information to determine the competitor’s eligibility to enter and to win the Competition.
4.0 When and how to enter Stage 1 of the competition
4.1 The Competition commences on Thursday 22 March 2018 at Midday (AEST) and Stage 1 concludes on Saturday 30 June 2018 at 11:59 pm (AEST).
4.2 Competitors must accept all Terms in order to participate in the Competition.
4.3 Competitors must login to the online competition webpage. Once logged in, to enter the competition competitors must answer a question, and then in 25 words or less describe why they want to Experience Queensland.
4.4 Only one entry is permitted per individual.
4.5 Competitors must use only one login account in order to participate in the Competition.
4.6 Once Stage 1 of the competition closes, an internal judging panel will select the 10 best entries to proceed to Stage 2, by 5pm (AEST) on Friday 13 July 2018.
5.0 Stage 2 of the Competition and the Competition Winner
5.1 The 10 best entries will then be judged by a final judging panel (including external and Department officers) to select a winner of the Competition.
5.2 The Stage 2 concludes on Friday 27 July 2018 at 5pm (AEST). Once Stage 2 of the Competition is complete, the Department will announce the winner and publish the winning entry on its website and social media channels.
5.3 The winner of the Competition will receive the following prize:
5.3.1 Return economy airfares from the winner’s nearest connecting airport (as negotiated between the Airline Sponsor and the winner) to Brisbane, Queensland, Australia for the winner and one guest to attend the AusBiotech 2018 conference.
5.3.2 Two tickets for the winner and guest to attend the AusBiotech 2018 conference from 31 October 2018 to 2 November 2018;
5.3.3 Hotel accommodation for the winner and guest (as determined by the Accommodation Sponsor) during the AusBiotech 2018 conference from 29 October 2018 to 4 November 2018;
5.3.5 Invitations for the winner and guest to a Glamping experience in Queensland before or after the AusBiotech 2018 conference;
5.4 The Department will, at its absolute discretion, determine the appropriateness of prizes based on considerations including, but not limited to, the location / domicile of the Competition winner.
5.5 If the prize is unavailable, the Department, in its sole and absolute discretion, reserves the right to substitute the prize with a prize of approximately equal value and/or specification.
5.6 The prize cannot be transferred, exchanged or redeemed for cash. If for any reason the winner
5.6.1 does not accept or take the prize;
5.6.2 is ineligible to receive the prize or to participate in the Competition;
5.6.3 does not demonstrate to the Department the winner’s ability to participate in the prize activities;
5.6.4 has not complied with the Competition Terms; or
5.6.5 has not complied with any obligation or condition required by the Department to accept the prize;
By Friday 10 August 2018 at 5pm (AEST), then the prize will be forfeited by the winner and cash will not be awarded in lieu, and the Department reserves the right to select an alternate winner or no winner.
5.7 It is a condition of accepting the prize that the winner must sign any legal documentation with the Department, in the form determined by the Department, which gives effect to the granting of the prize to the winner.
5.8 In participating in the Competition, the winner agrees to participate and co-operate as reasonably required in all activities (including promotional activities) related to the Competition, including but not limited to being interviewed and photographed (“Competition activities”). The winner agrees to acknowledge the Department and sponsors in all Competition activities. The winner grants the Department a royalty fee, perpetual, non-exclusive right to use, adapt, reproduce and publish any material arising from the Competition and/or Competition activities for any purpose connected to the Competition and associated events.
6.0 Winner and Guest responsibilities
6.1 The Competition winner and their guest will be responsible for:
6.1.1 each holding a current passport for the period of 27 October 2018 to 4 November 2018 (“the travel period”;
6.1.2 remaining able to travel during the travel period;
6.1.3 remaining contactable by the Department during the Competition and travel period;
6.1.4 providing all information and consents necessary for the administration of the Competition and provision of the prize by the Department;
6.1.5 obtaining a suitable visa for travel to Australia and participating in the Competition prizes;
6.1.6 obtaining and holding appropriate travel insurance for travel and their stay in Australia and participation in the Competition prizes;
6.1.7 providing spending money for meals and all other expenses other than those expressly included in the Competition prize;
6.1.8 where the guest is under 18 years of age, the winner supervising the guest at all times during the travel period.
6.1.9 ensuring that the winner and guest will be available to travel at the relevant dates and times and meet any other requirements of travel to and from Australia.
6.1.10 promptly notifying the Department of any problem or issue that may prevent the winner and guest from receiving the prize or making use of the prize, including any problem complying with the winner and guest responsibilities or these Competition Terms.
7.0 No liability
7.1 The Department will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the Competition except for any liability which cannot be excluded by law. The Department is not responsible for any incorrect or inaccurate information, either caused by the competitor or any of the equipment or programming associated with, or utilised in this Competition, or for any technical error, or combination thereof that may occur in the course of the administration of this Competition, including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite failure, theft, or destruction or unauthorised access to, or alteration of entries.
7.2 If for any reason, this Competition is interfered with in any way or is not capable of running as planned, including due to infection by computer virus, bugs, tempering unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Department which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Department reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the Competition.
7.3 Except for any liability that cannot be excluded by law, the Department (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury, loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition, including but not limited to, where arising out of the following:
7.3.1 any technical difficulties or equipment malfunction (whether or not under the Department’s control);
7.3.2 any theft, unauthorised access or third party interference;
7.3.3 any entry, submission or acceptance that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Department;
7.3.4 any variation in prize value to that stated in these terms;
7.3.5 any tax liability incurred by the winner;
7.3.6 the publication of any material relating to the Competition, including competition entries and statements made by any person; and/or
7.3.7 participation in the Competition.
7.4 In the event that liability cannot be excluded under the Competition Terms, liability is limited to the value of participation in the Competition or $100, at the discretion of the Department.
7.5 Competitors must only participate in the Competition (including using third party software and platforms) in a manner that does not infringe the rights of others or restrict or inhibit the participation of others in the Competition. This includes refraining from conduct which:
7.5.1 is unlawful;
7.5.2 may harass or cause distress or inconvenience to any person;
7.5.3 involves the transmission of obscene or offensive content; or
7.5.4 brings the Department or the Competition or its sponsors into disrepute.
7.6 A competitor must not post or transmit, any unlawful, defamatory, obscene, offensive or scandalous material, or any material that constitutes or encourages conduct that would contravene any law.
7.7 If a competitor breaches these Terms, the State may immediately terminate their participation in the Competition.
8.1 Personal information collected by the Department, will be handled in accordance with the Information Privacy Act 2009 (Qld).
8.2 The type of personal information the Department may collect includes the competitor’s name, email address, age, phone number, location, photo or video likeness and any other personal information expressly stated to be collected in these Terms.
8.3 The competitor’s personal information will be collected, used, published and disclosed for the administration and promotion of the Competition and its associated activities, for similar events, and for any other purpose permitted under these Terms.
8.4 The competitor’s personal information may be disclosed to third parties such as the Department’s contractors, Competition sponsors, prize organisers and associated service providers, and external members of any evaluation panel of the Competition.
8.5 The competitor consents to their personal information (including in photo or video footage format) being collected, used, published or disclosed by the Department as stated in these Terms.
8.6 The winner agrees to procure their guest’s consent to the guest’s personal information being collected, used, published or disclosed by the Department as stated in these Terms (in relation to a competitor).

9.1 The Competitor grants to the Department a perpetual, irrevocable, non-exclusive, royalty-free, worldwide licence (including right of sublicense) to use, adapt, reproduce, publish, and exploit any material submitted by the Competitor in relation to the Competition, for any purpose connected to the Competition or similar events.
10.1 The Competition is conducted in Queensland via the internet, and is subject to the laws of Queensland, and the exclusive jurisdiction (except for courts of appeal) of the courts of Queensland.
11.1 The Department may terminate the Competition, reduce its scope or terminate a competitor or winner’s participation in the Competition in its sole and absolute discretion at any time.
11.2 If the Competition or a competitor or winner’s participation in the Competition is terminated, clauses 2, 5, 6, 7, 8, 9, 10 and 11.2 survive that termination.
11.3 These Competition Terms form the entire agreement and understanding between the Department and the competitor.
