The Department of Environment and Science is proposing to make an amendment to a protected area and is seeking views in consideration of the Human Rights Act 2019, including Aboriginal peoples’ and Torres Strait Islander peoples’ cultural rights.

The Department of Environment and Science is proposing to make an amendment to the protected area estate and is seeking views in consideration of the Human Rights Act 2019, including Aboriginal peoples’ and Torres Strait Islander peoples’ cultural rights.

The amendments to be made are as follows:

Lawn Hill (Creek) Resources Reserve Mount Isa City

Omit the entirety of Lawn Hill (Creek) Resources Reserve being an area of about 160 hectares described as lot 9 on CP850717, to remove an invalidly dedicated resources reserve.

It is the Department’s view that the Lawn Hill (Creek) Resources Reserve was not validly made as there is no evidence that the previous tenure of Reserve for Departmental and Official (Natural Resources) Purposes under the Land Act 1962 was revoked. For this reason, dedication of the resources reserve under the Nature Conservation Act 1994 is invalid.

Comments received by 12 December 2023 will be considered by the department.

Amendments to the protected area estate under the Nature Conservation (Protected Areas) Regulation 1994 are administered by the Department of Environment and Science.
